Earlier this month, Governor Hochul signed a chapter amendment that amends the state’s “wage theft” law. This amendment requires that the aggrieved party give contractors notice of any alleged violations and no civil actions can take place until 10 business days after giving notice. And, they cannot bring a civil action if the contractor corrects the alleged violation. The chapter amendment takes effect on July 16, 2022 and shall apply to construction contracts entered into, renewed, modified or amended on or after such effective date and shall only apply to wages, benefits, and/or wage supplements earned on or after such effective date.
