The NYS Dept. of Labor recently made a change to the COVID-19 Paid Sick Leave requirements for employees seeking paid leave for a second or third time. The new guidance now states: “The second and third orders must be based on a positive COVID-19 test and the employee must submit documentation from a licensed medical provider or testing facility attesting that the employee has tested positive for COVID-19.” Previously, employees simply needed to self-affirm a positive COVID-19 test to qualify for the additional paid COVID-19 sick leave.
