Earlier this week, NYS Department of Labor released proposed regulations deriving from the HERO Act, requiring worksites to establish workplace safety committees following a written request for recognition by at least two non-supervisory employees. It contains the powers and functions of the committees, as well as employer obligations. There is a public hearing on the regulations on February 9, 2022 at 11:00 am (location to be determined), and public comments will be received for an additional 5 days. In the meantime, other aspects of the HERO Act remain in effect and will continue until such time the New York State Department of Health Commissioner reviews the level of transmission of COVID-19 in New York State, and determine whether to continue this designation. The next “review” will be January 15, 2022.
