Back in September, Governor Kathy Hochul announced that the Commissioner of Health had designated COVID-19 a highly contagious communicable disease that presents a serious risk of harm to public health under New York State's HERO Act. That designation required all employers to implement their workplace airborne infectious disease safety plans, helping to prevent workplace infections. This was to remain in effect until October 31, 2021. On Sunday night, the Commissioner of Health issued a new designation pursuant to Labor Law § 218-b for COVID-19, extending the designation until December 15, 2021. This means that you must continue to comply with provisions of the New York Health and Essential Rights Act/NY HERO Act.
