Yesterday, OSHA released the anticipated COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS), which can be found here and was published in today’s Federal Register. Per the ETS, employers with 100 or more employees (i.e., “covered employers”) will be required to: • Get Their Employees Vaccinated by JANUARY 4 (previous deadline was Dec. 8) and Require Unvaccinated Employees to Produce a Negative Test on at Least a Weekly Basis • Pay Employees for the Time it Takes to Get Vaccinated • Ensure All Unvaccinated Employees are Masked. • Be in compliance with all other requirements on December 5. • Report and keep records of certain instances that are spelled out in the detailed OSHA materials available here. The ETS rules also streamline the implementation and set one deadline across different vaccination requirements.
