As we alerted the general membership earlier this week, the NY State Department of Labor recently updated the COVID-19 Paid Sick Leave Guidance and Frequently Asked Questions (FAQs), and there is a significant change to the benefits section regarding the definition of "wages." The FAQs now state that the definition of "wages" for the purposes of Covid Paid Sick Leave is defined under Article 6 of the Labor Law. Under the new definition, employers are required to pay wages and benefits including, but not limited to, reimbursement for expenses; health, welfare and retirement benefits; and vacation, separation or holiday pay. This update suggests a significant expansion in the scope of the benefit employers must pay eligible employees, and it does so in contrast to the statutory language. Until clarification or further guidance is made available, employers failing to follow this new guidance may be at risk for noncompliance.
