We are awaiting official confirmation, however, we have heard that the Governor and Legislature have agreed to a chapter amendment to delay the creation of a certified payroll system for all prevailing wage projects until January 2026. The law, which was signed by the Governor in early September, added a new section 220-j to article 8 of the labor law which details relevant definitions, covered projects, the information required to be submitted electronically by each contractor, the applicable penalties for failure to do so, and set a date of December 31, 2024, for the Department of Labor (DOL) to implement such system. There was concern regarding the implementation date when the Governor signed the bill into law, so this potential action is not a surprise. ECA will continue to follow this issue and will update the membership once this becomes official.
