Earlier this week, New York DOL released a fact sheet and FAQ information related to the application of prevailing wages to aggregate hauling. The fact sheet provides better clarity on the requirements on when to pay prevailing wage, the geographic boundaries and the exceptions to the requirements. The FAQs provide better definitions (such as “worksite” and “central stockpile”), explain items such as how the DOL will measure the 50-mile radius, and answer questions related to specific scenarios (ie: one-off deliveries, single vendor with multiple drivers, travel within multiple counties, etc.) As a reminder, the Bureau of Public Work is now enforcing the 50-mile radius provision on projects solicited on or after July 1, 2024
