Our colleagues at AGC-NYS recently shared with us that the NYS Department of Labor and the NYS Department of Transportation have determined that a driver required to be paid NYS Prevailing Wage is also required to take an OSHA 10-hr. class and provide proof of their successful completion of the course. In Nassau and Suffolk counties, drivers who haul asphalt and/or concrete from commercial plants to or from a public work project not more than 50 miles away, are required to be paid prevailing wages. In all other counties, prevailing wage does not apply to asphalt or concrete. Therefore, no certified payroll or OSHA safety course is required. For aggregate supply construction materials, certified payroll is required for any truck driver where prevailing wage applies. This includes Contractors, Subcontractors, Trucking Firms and Material Suppliers. The reporting requirement is the same as with other employees.
