ECA recently sent a letter of support to state Legislative leaders supporting S8413A/A8981A, which is legislation that amends the state’s penal law to make staging a Construction site accident for the purposes of insurance fraud a class E felony. The deliberate staging of a construction accident for financial gain by filing a false insurance claim is a growing problem, perpetrated by both individuals and organizations. These false claims have led to increases in insurance premiums in NYS, resulting in contractors having to pass costs on to building owners/developers.
