Governor Kathy Hochul signed legislation (S.4887/A.5608) into law last week, enacting the Roadway Quality Assurance Act, which mandates that utility company contractors and subcontractors pay the prevailing wage to employees on projects where a permit to use, excavate, or open a street is required to be issued. These amendments to existing Labor Law were championed by the NYS Building & Construction Trades Council, with the Laborers and Operating Engineers leading the charge. This act takes effect September 15, 2023 (30 days following the Governor’s signature), and shall apply to all contracts for construction executed and permits issued on or after such date.
