Eastern Contractors Association joined with the Laborers, Associated General Contractors of New York State, Construction Contractors of the Hudson Valley and others to file a legal action before the Commissioner of Education relative to a “piggybacking” procurement of public work construction for the Bethlehem Central School District. It is our belief the approach to piggybacking – a part of Section 103 of General Municipal Law – for public work construction as opposed to mere basic installation of purchased materials and equipment to be extra-legal. Bringing action before the Commissioner of Education utilizes a little-known part of the law that was successfully employed by the General Building Contractors (now part of ACG) many years ago to set critical precedent.
