ECA Joins Forces in an Action Before the Commissioner of Education

Eastern Contractors Association joined with the Laborers, Associated General Contractors of New York State, Construction Contractors of the Hudson Valley and others to file a legal action before the Commissioner of Education relative to a “piggybacking” procurement of public work construction for the Bethlehem Central School District.
 
It is our belief the approach to piggybacking – a part of Section 103 of General Municipal Law – for public work construction as opposed to mere basic installation of purchased materials and equipment to be extra-legal. Bringing action before the Commissioner of Education utilizes a little-known part of the law that was successfully employed by the General Building Contractors (now part of ACG) many years ago to set critical precedent.
