In accordance with President Biden’s regulatory freeze memo issued on Inauguration Day, the Department of Labor’s Wage and Hour Division (WHD) issued a notice which will appear in tomorrow’s Federal Register to finalize the Biden administration’s delay of the effective date for the Trump administration’s independent contractor rule until May 7, 2021. The rule was set to take effect on March 8, 2021. A number of the national groups ECA is associated with have been working with the Biden administration to implement this delay and submitted formal comments to the WHD, setting up the legal and policy justifications for this delay.
