Construction Exempt from 100% Workforce Reduction

Within 36 hours, Governor Cuomo issued three Executive Orders that mandate businesses reduce their in-person workforce as a response to the COVID-19 pandemic. The third order which came this morning, set that reduction at 100%.

However, construction is exempt from these Orders and work can continue with your full crews.

The Order also exempts vendors that provide essential services or products, so your materials and supplies should not be impacted either.

Click here for the official guidance and listing of exempt businesses (construction is item #9).

However, your workforce must practice social distancing of at least 6 feet. And you should continually emphasize good practices regarding hand washing, covering mouths and noses when coughing or sneezing and disinfecting work surfaces and tools.

You should also look at your in-office staff and work to have your non-essential staffers work remotely if possible. Some office spaces limit the ability for people to maintain a 6-foot distance and you need to keep your staff away from one another as much as possible. Also make sure best practices are being used (hand washing, disinfecting surfaces, etc.)

If any of your workforce is ill, it is imperative that you send them home and have them call their doctor or local health department for additional guidance.

The Centers for Disease Control and Prevention has guidance for businesses here. NYS Department of Health also offers an info sheet to explain contacts of contacts -- find it here.
